U.S. District Court Judge Claudia Wilken denied Ford's motions to dismiss plaintiffs' claims and held that plaintiffs' claims under the California Consumers Legal Remedies Act and the Unfair Competition Law could go forward. (August 6, 2004 Order) and (March 24, 2004 Order) Judge Wilken granted plaintiffs' motion for class certification on September 8, 2004. (September 8, 2004 Order)
In March 2005, the Ninth Circuit Court of Appeals denied Ford's petition requesting interlocutory appeal of the District Court s Order granting class certification. (March 31, 2005 Order). Judge Wilken denied Ford's Motion for Summary Judgment in part and granted it in part. (May 4, 2005 Order). This case was set for trial on May 16, 2005. On May 13, 2005, the parties reached a settlement agreement that provided relief to a nationwide class. Ford provided a retroactive seven-year extended warranty coverage for the plastic intake manifold in the cars in the above table. On October 7, 2005, Judge Wilken approved the Proposed Settlement. The Settlement became final and effective on December 16, 2005.
