Hardieshake, King County Superior Court (Washington State)
This class action concerned owners of homes with roof shakes manufactured by James Hardie Building Products, Inc. ("JHBP") using such brand names as "HardiShakes" and "HardiSlate" among others (collectively "JHBP Roof Shakes").
Plaintiffs alleged that the roofing products absorb excessive moisture, rot, break, deteriorate or otherwise fail when installed and incorporated on buildings and structures. Plaintiffs sought compensation for themselves and other owners of property on which JHBP Roof Shakes have been installed for alleged damages as a result of failure of the roof shakes. JHBP denied all charges of wrongdoing or liability of any kind whatsoever asserted or which could have been asserted in this Litigation and has asserted and continues to assert various defenses to the individual and class action claims.
In 2001, the case was settled, and in 2002 the court approved a process to compensate class members for damages associated with their JHBP Roof Shakes as defined by the Settlement Agreement.
